Terms and Conditions:
  1. VALIDITY OF THE ONLINE STORE TERMS

    1.1 The owner of the online store located at the internet address NaudinLingerie.com (hereinafter referred to as the Online Store) is Naudin Lingerie OÜ, registry code 16845082 (hereinafter referred to as the Seller).

    1.2 The terms of use of the online store (hereinafter referred to as the Terms) apply to legal relationships arising between the customer (hereinafter referred to as the Customer) and the Seller regarding the purchase of products from the Online Store. The Terms are inseparably linked to the Privacy Policy.

    1.3 By registering as a customer in the online store or making a purchase, the Customer agrees to the Terms and the Privacy Policy and undertakes to comply with them.

    1.4 In matters not regulated by the Terms and/or the Privacy Policy, the Seller and the Customer shall be guided by the relevant laws of the Republic of Estonia.

    1.5 The Seller has the right to amend the Terms and the Privacy Policy as well as the prices of products. The Seller will inform about the changes at the internet address NaudinLingerie.com. The transaction shall be subject to the conditions and prices in force at the time of the transaction.

    1.6 All product photos and texts displayed in the online store are protected by copyright owned by the Seller.

    2. PRICE AND PRODUCT INFORMATION

    2.1 The products displayed in the online store are usually available in stock. The availability of products displayed in the online store may change due to technical issues in the online store or warehouse programs, and in such cases, the Seller does not guarantee the fulfillment of the order.

    2.2 If after placing the order by the Customer, it is found that the product is out of stock and the order cannot be fulfilled, an employee of the Online Store will contact the Customer and propose a possible new delivery time or replacement of the product with an equivalent alternative product of the same price and quality, or the refund of the money paid for the product.

If the Customer requests a refund, the money will be refunded immediately, but no later than 14 days after placing the order.

2.3 The product images displayed in the online store are for illustrative purposes and may differ from the actual product. The product descriptions provided in the online store may not be exhaustive and may contain unintentional errors.

2.4 All prices displayed in the online store are in Euros and include VAT.

2.5 The Seller has the right to change the prices displayed in the online store at any time. If the prices in the online store have been changed after the Customer has placed and paid for the order, the Seller undertakes to deliver the ordered products at the prices valid at the time of placing the order. The Customer has no right to demand compensation for the price difference.

3. PLACING AN ORDER IN THE ONLINE STORE

3.1 The user of the online store confirms that they are at least 16 years old.

3.2 The Customer selects the desired products in the online store and adds them to the shopping cart by clicking the “Add to Cart” button.

3.3 It is possible to change the quantities in the shopping cart and remove items from the shopping cart until payment is made. To save changes, click the “Update Cart” button.

3.4 To place an order, the Customer must go to the Cart page and click the “Checkout” button, which will redirect the Customer to the checkout page.

3.5 On the checkout page, the Customer must fill in the required fields, select the delivery method and payment method, confirm familiarity with and acceptance of the website’s terms of use, and click the “Place Order” button, which will redirect the Customer to pay for the products.

3.6 The Customer pays for the products immediately via an internet bank link. The payment can be securely made using credit card (Visa, Mastercard).

3.7 The payment is made in a secure payment environment provided by the service provider Stripe. The Seller does not have access to the Customer’s bank details.

3.8 The Customer undertakes to provide the accurate data necessary for order fulfillment when placing the order. The Seller is not responsible for the impossibility of fulfilling the order, delay, or any consequences resulting from incorrect data provided by the Customer when placing the order.

3.9 If the order cannot be fulfilled due to the product being out of stock or for any other reason, the Seller will notify the Customer as soon as possible and refund the cost of the order to the same bank account from which the Customer paid for the order.

3.10 The sales contract between the Customer and the Seller comes into force upon receipt of the payment amount due to the Seller’s bank account.

4. DELIVERY TIME AND DELIVERY CONDITIONS

4.1 The Customer selects the delivery method, including the postal service provider, when placing the order at the checkout.

4.2 The order is dispatched by the Seller within 2-10 working days, and the delivery time to the Customer depends on the postal service provider chosen by the Customer.

4.3 Upon arrival of the product at the parcel or post office, the Customer will be notified by SMS and email. The goods are held in the parcel machine/post office according to the service provider’s rules. If the Customer does not pick up the order within the specified time, the parcel will be returned to the Seller, who will contact the Customer to arrange for the order to be received.

5. RETURNS

5.1 The Customer has the right to withdraw from the order within 14 days. The 14-day period starts from the moment the Customer receives the order.

5.2 The right of withdrawal does not apply if the Customer is a legal entity.

5.3 To return the product, the Customer must send a withdrawal notice to the Seller by email at info@naudinlingerie.com.

5.4 To exercise the right of withdrawal, the product must not be used in any way other than necessary to ascertain its nature, characteristics, and functioning in the same way as the Customer is allowed to do in a physical store. The product returned to the Seller must be flawless, complete, and unused.

5.5 The Customer undertakes to return the product within 14 calendar days from sending the withdrawal notice to the Seller or to provide evidence that they have handed over the goods to the postal service within the aforementioned period.

5.6 To return the product, please write to the email address info@naudinlingerie.com.

5.7 The Seller will refund the purchase amount to the Customer within 14 days from the receipt of the returned product to the Seller’s bank account from which the Customer paid for the returned product.

5.8 The cost of returning the goods shall be borne by the Customer, unless the reason for the return is that the product does not correspond to what was ordered (e.g., wrong or defective product).

5.9 If the Seller determines that the returned product has been used for purposes other than necessary to ascertain its nature and characteristics or if there are signs of use or wear and tear on the product, the Seller has the right to reduce the refundable purchase amount according to the decrease in the value of the product.

6. PROCEDURE FOR SUBMITTING CLAIMS

6.1 In the case of sales to a consumer (hereinafter consumer sales), the Seller is responsible for non-conformity with the contract terms that become apparent within two years from the handover of the item to the Customer (Estonian Law of Obligations Act § 218).

6.2 In the case of consumer sales, it is presumed that any non-conformity with the contract terms that becomes apparent within six months from the date of delivery of the item to the Customer was already present at the time of delivery. It is the responsibility of the Seller to refute this presumption.

6.3 In the event of a defect in the product, the Customer undertakes to notify the Seller immediately, but no later than within two months of becoming aware of the defect, by sending an email to info@naudinlingerie.com (hereinafter a claim). The claim must include the order number, the Customer’s contact information, and a description of the defect as accurately as possible.

6.4 The basis for submitting claims is the document proving the purchase.

6.5 Claims submitted by the Customer will be reviewed, and the Customer will be contacted as soon as possible, but no later than within 14 calendar days from the receipt of the claim.

6.6 The right to submit a claim does not extend to teaching, adjusting, maintaining, cleaning, restoring the commercial appearance of the product, or eliminating defects caused by failure to follow the instructions for use.

6.7 The right to submit a claim does not cover damages that occur after the delivery of the product to the Customer during transportation.

6.8 The Seller does not remedy defects that occur during the right to submit a claim for free if they are caused by:

6.8.1 normal wear and tear;

6.8.2 improper use or maintenance;

6.8.3 external factors. External factors include, among other things, moisture, liquids, mechanical damage, etc.;

6.8.4 failure to follow the instructions for use or if defects occurred due to improper storage or maintenance of the product.

6.9 The Seller relies on an expertise conducted by an authorized representative of the manufacturer to determine liability. If as a result of the expertise it is determined that the defects are caused by the aforementioned factors, but the product can be repaired, the Customer has the option to order the repair of the product from the manufacturer and pay for it themselves.

6.10 If the Customer does not agree with the Seller’s position, the Customer must prove that: 6.10.1 there is a defect (non-conformity with the contract terms); 6.10.2 the defect or its cause existed at the time of delivery of the product; 6.10.3 the Seller is responsible for the defect.

6.11 If the Seller has provided a warranty for the product, then the Seller ensures the elimination of defects in accordance with the warranty conditions.

 

7. PERSONAL DATA AND THEIR USE

7.1 The responsible data controller of the online store is Naudin Lingerie OÜ (registry code 16845082).

7.2 The Customer gives their clear and informed consent to the processing of their personal data by the Seller.

7.3 The processing of personal data is subject to the Privacy Policy.

7.4 The Seller may send sales offers and information about campaigns to the Customer by email only if the Customer has given their consent on the order placement page by checking the appropriate box.

8. LIABILITY

8.1 The parties are liable to each other for damages caused by the breach of the Terms.

8.2 The Seller is liable to the Customer for the selling price of the product sold.

8.3 The Customer undertakes to use the online store service only in accordance with the law and based on good practices.

9. OTHER CONDITIONS

9.1 Disputes between the parties shall be resolved through negotiations.

9.2 In case of failure to reach an agreement, the Customer has the right to file a complaint with the Consumer Disputes Committee (www.komisjon.ee) or a court.
